A man was arrested after the bank insisted his bank account had 5 million dollars in it and it was his money... so he withdrew it. gave some away and spent the rest.... After this, the bank relized they had the wrong guy and it was someone elses money..

I agree with you, he knew it wasn't his money to spend but at the same time he shouldn't have been arrested for it. The bank made a serious error. If they insisted it was his they should recompense the real person whose money it was. they make enough money anyway and are probably covered somewhere on some sort of insurance. What crime was he arrested for. Obtaining money by deception. He didn't deceive, he told them it wasn't his. Banks responsibility and they should look at it as a hard lesson learned. He did try to invest it, but he lost what he invested, so I guess it goes to show that he did not have good skills for investing, at least he tried is what I have to say... However, I think the bank should eat crow because he is going to probably end up filing a bankruptcy over it and while the items he bought may be returned, but I don't think they will recover near the money that he spent. This guy should not be subjected to any criminal charges being that it was the bank at fault. The bank should have to take it as a loss. But there is also a lesson in honesty. This guy definitely knew the money didn't belong to him. So he shouldn't have spent it. I don't know, I mean... If he knew it wasn't his money, then he knew he was stealing even if the bank didn't. It was wrong for him to take it and spend it. Just because the bank said it was his and made a mistake does not erase what he did. definitely he should have to pay it back, but i don't think he should have been arrested over this especially when he tried telling them it wasn't his. he should have just kept it in the bank though until they figured it out because now he's in not only a lot of trouble but all the money he spent is gonna have to be paid back and obviously like he said, he didnt have that kind of money. i feel sorry for the guy to an extent, but he should have known better to withdraw the money when it wasn't his. He did after all KNOW that it was not his money and that sooner or later the bank would see their error. I would not have withdrawn it and spent it because I would have known there was no way possible that I could pay it back. 5 million is a lot of money. I agree and disagree with you. Its different saying this stuff to being in this situation where a BANK tells you you have 5 million, if they really do instist it is yours then by law you can spend it after 6 years (Well thats the law here in the UK, and thats if the bank dont take it offf you) But most people wouls start into it after a short while to pay off debt etc. It has happened to me with a much smaller amount, and after 2 years i didnt see the point of getting my bank balance with money in there which was not mine, but they insisted it was mine. So i spent it, and they have never come back to me about it! Its all very good saying that he should pay it back, could any of you just on the spot or over the rest of your life just pay 5 million back as well as have a life!?? NO! I don't think he should be arrested because he does not stole the money. What will the bank charge for him. It was being insisted to him as his money. Maybe what the bank can do now is to get the properties owned by that man that he has accumulated from that money. On the other hand, it is not proper to spend the money as he knows it is not his. Before he did that thing, I think he should think of the possible consequences and make sure will have a remedy is ever the money will be taken back to him because it is not his. I have had a similar experience...but on a WAY WAY smaller scale. I instructed the bank to place the disputed amount of money into a seperate account (that I opened) and left it there until they straightened it out. That way I wouldn't accidentally spend any of it. He KNEW it wasn't his money..so he should not have spent it, but jailing him is pointless, since he tried to tell them it wasn't his..and had no evil intent. Trying to make him pay it back is a joke...obviously he did not have that sort of money before, or he would have invested it, not wasted it. The bank should eat some of the costs, and take some of the responbibility...after all they are trained to manage vast sums of money..that is what we PAY them to do. [Ridgerunner]

You know banks do make mistakes and being banks they eventually do find those mistakes. The man knew that the money wasn't his so he should not have spent it. But at the same time he should not have been arrested. He should have to pay it all back. I can do you one better. Here in South Carolina a man was arrested and spent 6 hours in jail for making a deposit. He entered the bank with what looked like a duffel bag and ask the teller for a piece of paper. She thought he was going to rob the bank so pushed the police button. he made his deposit and as he was leaving the bank the police had him. He is now suing the police department and the bank. he wants an apology which he hasn't gotten so far. The police chief says that her officers acted appropriately. I think that the bank manager could have saved this man a lot of embarrassment by simply telling the officers what happened. [deebomb]
The girl just left him at the window and went and pushed the alarm. Another tell finally waited on him. He was arrested as he was leaving the bank. I think I would sue the girl too. They all could apologize and every thing would be fine as I understand the news report. I think when the police make a mistake like that they should apologize. Well, forst place the guy had to know it wasn't his money, I mean if I went to my bank and I was told I had that kind of money in there, I would know a mistake was made somewhere. I'm not really sure how to answer this. The bank, yes made the mistake, but the guy still took the money he knew was not his. They are both at fault here, but this man had the opportunity to do the right thing and he didn't. I'm not sure what he'd be charged with because it was just, litterally, handed over to him, but it all comes down to he accepted money that he KNEW was not his. This is the same concept if a cashier gave you more change than you were entitled to only on a much larger scale. Wrong it wrong. Wow... if its happened to him, i think he should ask the bank for clarification. Maybe they will throw him to the jail. Actually it was very nice mistake made by bank itself, anyway, a good citizen should ask more clarification about those weird things that happened in his account.
